Sole Proprietorship/Partnership

Two (2) type of Business

1. Sole proprietorship: Business wholly owned by a single individual using personal name as per his / her identity card or trade name.

2. Partnership: Business owned by two or more persons but not exceeding 20 persons. Identity card name can’t be used as business name.

How to start a business?

1. Registration of a new business to be done within 30 days from the date of commencement of the business.
2. Registration can be done at any SSM counter  or through the e-Lodgment 
3. Complete the Business Registration Form (Form A) to Guidelines for New Business Registration 
 
Business may be registered using personal name or using a trade name.
(i)  Personal Name – Business name using personal name as stated in the identity card is not required to apply for business name approval.

(ii) Trade Name – Complete business name approval form (Form PNA.42).  Guidelines for Business Name Application

4. Business names approval is according to Rules 15, Rules of Business Registration 1957

5. Business Registration can be made for a period of one (1) year and not more than five (5) years.

Who can submit Form A?

The owner/one of the partners

Fee?

Trade Name – RM60 per year
Personal Name – RM30 per year
Branch (s) – RM5 per year for each branch
When Business Registration Certificate can be obtained?
Within 1 hour after payment

Making Changes

Notify business particulars changes?

1. Notify Registrar within thirty (30) days from the date of changes using the prescribed form.

2. Changes of business particular can be registered by submitting Form B.

Changes of business particular can be registered are as follows:

(a) Changes of Business Address

(b) Changes of Business Type

(c) Changes of Particulars on Branches

(d) Changes of Information of Owner or Partner

3. Complete the form according to types of changes. Refer to Guidelines for changes in Business Particulars.

Who can notify changes?

Changes of Business Address – The owner/one of the partners

Changes of Business Type – The owner/one of the partners

Changes of Particulars on Branches- The owner/one of the partners

Changes of Information of Owner or Partner – All partners

 

Fee?

Business update fee – RM20
Branch(s) – RM5 per year for each branch
 

When Business Registration Certificate can be obtained?

Within 1 hour after payment

Business Renewal

How to renew business registration?

An application for the renewal of a business shall be made within three (3) months before the date of expiry of registration or the previous renewal using the prescribed form. (Form A1

Refer to guidelines for renewal of business registration 

Renewal of Business Registration can be made for a period of one (1) year and not more than five (5) years.

Business renewal cannot be made for a business expired more than one (1) year.

Closing Business

How to terminate registered business?

1. Where a business registered has been terminated, the person responsible for the business shall within thirty (30) days of the termination notify the registrar in the prescribed form (Form C).to Guidelines on Termination for Business

2. Business may be terminated for the following reasons:

    Cessation of the business

    Bankrupt

    Death of the owner

    Pursuant to Court Order.

3. Registered business that has not expired is allowed to submit Notice for

    Termination of Registered Business.

4. Submit the Notification as a result of death within four (4) months from the date of demise.

5. For business that had expired, Confirmation Letter on expired business can be requested with payment of RM10.00.

When result of application can be obtained?

Within 15 minutes after submission
